For most private assured tenancies in England, the position changed significantly on 1 May 2026. Fixed end dates no longer apply to these tenancies, which generally continue as rolling periodic tenancies instead.

Does a Tenancy Automatically End When the Date Expires?

Not necessarily.

Before the 2026 changes, many private tenants had fixed-term assured shorthold tenancies lasting six or twelve months. When the fixed term ended, the tenancy could continue as a periodic tenancy if the tenant remained in the property and the landlord accepted rent.

Under the current assured periodic tenancy system in England, an assured private tenancy cannot have a fixed end date. If an older agreement contains an end date, that date generally no longer applies.

This means a tenant does not automatically have to move out simply because the original date printed on an old tenancy agreement has passed.

What Happens to Tenancies That Started Before 1 May 2026?

Most existing assured and assured shorthold tenancies automatically became assured periodic tenancies on 1 May 2026.

The previous fixed end date stopped applying, and the tenancy continued on a rolling basis, usually monthly or according to the applicable rental period. Tenants did not need to sign a completely new tenancy agreement for this change to take effect.

Landlords also cannot simply rely on an old Section 21 clause to end the tenancy under the previous no-fault system.

Can a Tenant Stay After the Agreement's End Date?

For an applicable assured periodic tenancy, the tenant can generally remain in the property after the date that previously appeared as the end of the fixed term.

The tenancy continues until:

  • The tenant gives valid notice

  • The landlord and tenant agree to end it

  • The landlord legally regains possession

The tenant must continue paying rent and complying with the tenancy terms while the tenancy continues.

Can a Landlord Make You Leave When the Tenancy Expires?

A landlord cannot simply tell an assured periodic tenant to leave because an old fixed-term date has arrived.

If the landlord wants possession, they generally need a valid legal ground and must follow the correct possession procedure.

Depending on the circumstances, grounds can include:

  • Rent arrears

  • Antisocial behaviour

  • Serious tenancy breaches

  • The landlord wanting to sell

  • The landlord or certain family members wanting to move into the property

  • Serious damage to the property

The required notice depends on the ground being used.

Can a Tenant Leave When the Fixed Term Ends?

If you want to leave, you should not simply assume that moving out on the old end date automatically ends your obligations.

For current assured periodic tenancies in England, tenants generally need to give written notice. The maximum notice a landlord can require is two months, although the applicable tenancy arrangements can affect the exact notice requirements for some older agreements.

You should keep evidence of the notice you give and continue paying rent until the tenancy legally ends.

What If the Landlord and Tenant Agree to End the Tenancy?

A landlord and tenant can agree to end a tenancy by mutual agreement.

If you want to leave earlier than the required notice period, ask the landlord whether they will agree to an earlier date. Put the agreement in writing and clearly state the agreed date the tenancy will end.

This can help prevent later disputes over rent, keys or the deposit.

What Happens to the Deposit?

When the tenancy eventually ends, the landlord should deal with the deposit according to the applicable deposit protection rules.

If there are proposed deductions for damage, cleaning or unpaid rent, the tenant should receive an explanation and have the opportunity to challenge deductions where appropriate.

Tenants should take photographs of the property's condition when leaving and keep their check-in and check-out records.
