It applies where a let has been agreed and referenced and is then pulled. It is on the fee page, and it is here, because a “free” claim with a charge tucked behind it is worth less than no claim at all.
Terms of business are issued to you in writing before you are committed to anything, which is what the Estate Agents Act 1979 requires of us. If you already have an agent, check your existing agreement first: sole agency agreements carry notice periods, and instructing a second agent inside one can leave you owing two commissions on a single sale.
