If you have received a Section 21 notice from your landlord, how long you have before you need to leave depends on when the notice was served and the rules applying to your tenancy. The rules changed significantly in England on 1 May 2026, when Section 21 no-fault evictions were abolished.

How Long Do You Have After a Section 21 Notice?

Under the previous Section 21 rules, landlords normally had to give tenants at least two months' notice.

Importantly, receiving a Section 21 notice did not mean you had to leave immediately when the notice period ended. If you did not leave, the landlord generally had to obtain a possession order from the court before they could lawfully evict you.

For valid Section 21 notices served before 1 May 2026, transitional rules applied. Generally, landlords had up to 6 months from serving the notice to start possession proceedings, subject to the transitional deadlines.

Can You Stay After the Notice Date?

If the notice period has expired and you have not moved out, your landlord cannot simply remove you from the property themselves.

Where court proceedings are required, the landlord must follow the possession process. You should continue paying rent and comply with your tenancy obligations while the matter is being resolved.

A landlord cannot lawfully change the locks or physically remove you without following the required legal process.

What Changed From 1 May 2026?

Section 21 notices can no longer generally be issued in England from 1 May 2026. Instead, landlords must rely on a valid legal ground for possession and follow the appropriate Section 8 process.

This means that if your landlord is asking you to leave now, the relevant question is usually what legal ground they are relying on, rather than simply how long you have after a Section 21.

If You Received a Section 21 Before May 2026

If your landlord served a valid Section 21 before 1 May 2026, transitional rules may allow the possession process to continue. However, the deadlines are important, particularly because Section 21 proceedings could generally no longer be started after 31 July 2026.

What Should You Do?

If you have received a Section 21 notice, check:

  • The date it was served

  • The date you have been asked to leave

  • Whether the notice was completed correctly

  • Whether the landlord followed the applicable requirements

  • Whether court proceedings have been started

  • Whether you have rent arrears or other tenancy issues

  • Whether you need help finding alternative accommodation
