Updated October 2026
In short: Since 1 May 2026, landlords and letting agents in England can't refuse you simply because you receive Housing Benefit or Universal Credit. "No DSS" adverts are unlawful. You still need to show you can afford the rent, so it helps to know your Local Housing Allowance rate, have your documents ready, and work with agents who let to benefit-supported tenants regularly.
Know your numbers
| What to check | Why it matters |
|---|---|
| Your Local Housing Allowance (LHA) rate | It sets the maximum housing help for your area and household size; rates are frozen at April 2024 levels for 2026/27 |
| Bedroom entitlement | LHA depends on how many bedrooms your household is entitled to |
| Shortfall | Any gap between rent and LHA must be covered from other income or a Discretionary Housing Payment |
| Upfront costs | Up to one month's rent in advance, a holding deposit of up to a week, and a deposit of up to five weeks |
Strengthen your application
- Universal Credit or Housing Benefit award letter
- Photo ID and right to rent evidence
- Previous landlord reference or proof of good rent history
- Bank statements showing regular payments
- A guarantor, or a council rent deposit or bond scheme
- Ask whether rent can be paid directly to the landlord if you're eligible
Help with deposits
Many councils run rent deposit or bond schemes, and you may get a Discretionary Housing Payment towards a deposit or rent in advance. The Universal Credit budgeting advance is another option for some claimants.
If you're turned down
A landlord can refuse on affordability, references or other reasons, but not just because you claim benefits or have children. If you think you've been discriminated against, keep evidence and seek advice from Shelter or Citizens Advice.
